I can only add a guess that it is not the file that is in-use but 
rather a directory in the path.

If this is happening during IFS backups, the directory/path might be 
temporarily unavailable. Perhaps the program simply needs to monitor 
for this error, execute a delay for a minute, and loop back to try 
again.
