I think it depends entirely on the code that is parsing the document. I receive some documents that have empty tags, but some recipients will specify that this is not allowed (the Revenue Canada T4* electronic submission being a recent example I've seen).

I believe that the XML spec allows this, although <Order /> is the preferred form for an empty Order tag IIRC.
