I don't know if it's true or not. Sure makes business sense.
If that's ground for a lawsuit, how come nobody has sued
over the green-screen governor? I don't think it is ground
for any suit. This is a common practice. IBM makes a range
of AS/400s covering a wide range of performance. It does
not make sense to manufacture different hardware to cover
the range. Much better to control it in software.

I've even done that myself !  Back in the 60's I was working
for a Danish computer manufacturer (A/S Regnecentralen).
About 1968 we got a large order for a system for the
Danish Weather Service. As backing storage the RC/4000
(as the computer was called) used a magnetic drum.
The drum was very fast (much faster than a disk), but was
therefore also much more expensive. We sold it in two
configurations (256K and 512K - that K not M). The Weather
Service didn't have the it in the budget to get the large drum
when the computer was installed. We installed the large
drum anyway (actually all drums were large !). Next year
when money become available, they wanted to upgrade
to the large drum. I went out there and executed a command
to enable the operating system to utilize the large drum.

First, they were rather pissed, later they were actually
happy that they didn't have any downtime because of
the upgrade.  The technique is called "field-upgradeable".
