All they are being fined for is using non-public data so no one is not saying the ad was false. Sun is paying $10,000 for more national advertising. Not bad.

Last month or so there was a discussion about the SUN ads in
the WSJ claiming TPC-C results for their system vs IBM of 'XX vs 6'.
It turns out they were fined for that.
