IBM definitely refused to open source it. They brought it under control of
the CTC, with Rich I can't remember his last name in charge of it. He used
to monitor this list. You have the source. If you plan on selling it IBM
may be interested in their cut. For your own use I wouldn't expect much to
happen, even their downloadable version supplies source code,.

Precisely. Download it, modify it and use it, but realize it could be
argued that the modified copy belongs to IBM and not you.

If I remember correctly, IBM refused to open source CGIDEV2 over liability
concerns. I'm not sure we were ever given more specific information than
that.

Does anyone know whether CGIDEV2 is open source?


AFAIK, IBM has never granted what might appropriately be called an open
source license to CGIDEV2. At least, I've never seen an actual license.
To the contrary, each user who downloads CGIDEV2 must accept IBM's terms,
which include:

"IBM at all times retains ownership of the program/s or files and title to
all code licensed or otherwise furnished to you."

To me, that brief statement means that users agree that IBM holds all
intellectual property rights to CGIDEV2, including all rights to
derivative
works that you or anyone else may create.
