It is based on the explicit terms of the GPL, specifically section 4, which allows anyone who has a copy of the software to give a copy to anyone else, and section 10 which automatically grants a license, "from the original licensors", to anyone who receives a copy of the program.

I have no idea what you may be basing your rationale on, but ExtJS obviously believes they can conditionally offer GPLv3 or Commercial, and stipulate which consumers fall under which. And if they truly hold copyrights - they can.
